These Terms of Service ("Terms") govern your access to and use of our website, platform, tools, and services (collectively, the "Services") operated by PolicyPortal ("we," "our," or "us"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract to use our Services. By creating an account, you represent that the information you provide is accurate, current, and complete, and you agree to keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
2. Use of the Services

You represent that you have all necessary rights to submit your User Content and that it does not infringe upon the rights of any third party.
We do not claim ownership of your User Content and will not use it for marketing or advertising purposes without your express consent.
4. AI Tools and Information Disclaimer
Our Services include AI-powered tools and informational resources designed to assist insurance professionals. These tools and materials:
- Are provided for informational and educational purposes only and do not constitute legal, financial, or professional advice
- May produce outputs that are inaccurate, incomplete, or not suitable for your specific situation
- Should not be relied upon as the sole basis for any business, compliance, or policy decisions
You are solely responsible for evaluating and verifying any information or output provided by the Services before acting upon it. We strongly recommend consulting with qualified professionals for specific guidance.
5. Subscriptions and Payments
Certain features of the Services require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.
All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law. You are responsible for all taxes associated with your subscription.
We reserve the right to change our pricing at any time. If we change pricing for your current subscription, we will provide at least 30 days' notice before the new price takes effect.
6. Intellectual Property
All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, software, and design — are owned by PolicyPortal or our licensors and are protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in the Services or our content beyond the limited license expressly set forth herein.
7. Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the Services will immediately cease. We may, but are not obligated to, delete your account data after termination.
If you have an active paid subscription and we terminate your account without cause, we will provide a pro-rated refund for the unused portion of your subscription.
All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
8. Limitation of Liability
To the fullest extent permitted by law, PolicyPortal and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Services.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless PolicyPortal and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services or violation of these Terms
- Your User Content or any activity conducted through your account
- Your violation of any rights of a third party
10. Modifications to the Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or through the Services. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
11. Third-Party Services
The Services may contain links to or integrations with third-party websites, services, or content that are not owned or controlled by PolicyPortal. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Nebraska.
